TERMS OF SALES

Article 1 - Principles

These general conditions describe the rights and obligations of the parties, being understood as the rights and obligations of PLEINE LUNE SAS with a capital of €10,000, registered with the RCS of Nice under number 889 099 289 (hereinafter "the Seller"), and of the Customer placing an order on www.mun-watches.com (hereinafter "the Site"). They apply exclusively between the Seller and any Customer, natural or legal person, visiting the Site or making a purchase (hereinafter "Customer(s)").

On its Site, the Seller allows the Customer to order MU brand products online.

(hereinafter "the Product(s)") according to these General Conditions. Any order placed with the Seller therefore entails the unreserved acceptance by the Customer of these conditions. The General Conditions are accessible on the website www.mun-watches.com and will prevail, where applicable, over any other version or any other contradictory document.

These general terms and conditions of sale are valid until: 01/01/2026. They may be modified at any time and without notice by the Seller. Any order placed before the date of modification of these general terms and conditions of sale remains governed by the terms in force at the time of the order.

If any of the provisions of these terms and conditions is declared null and void or unenforceable by a competent court, it will not result in the nullity of the other provisions. These general terms and conditions are subject to French law with regard to the rules of substance and form. In the event of a dispute, the parties undertake to seek an amicable solution before considering legal proceedings.

Article 2 - PRODUCTS

The Products offered for sale are presented on the Site and are accompanied by a comprehensive description of the product. Each description includes the information necessary to allow the Customer to understand the essential characteristics of the Products, in compliance with Article L.111-1 of the Consumer Code. All Products offered comply with the standards applicable in France.

The Customer acknowledges, prior to any purchase and the conclusion of the contract, having taken full and complete knowledge of these general conditions of sale and the information listed in article L. 221-5 of the Consumer Code. This includes in particular the following elements:

  • (i) the characteristics of the Product

  • (ii) the price of the Product, method of calculation and various applicable taxes

  • (iii) transportation, postage and other charges payable

  • (iv) the delivery time within which the Seller undertakes to deliver the goods, in particular in the context of a pre-order

  • (v) information relating to the seller and his contact details

  • (vi) information relating to guarantees, their implementation, and other contractual conditions.

Descriptive information, including photographic and textual information, is provided with the greatest care. However, the Seller is not responsible for any errors or inaccuracies due to modifications of the elements provided by the component suppliers.

These conditions apply to all purchases made on the website mun-watches.com and delivered worldwide. These purchases concern the following products: watches – watch accessories.

Article 3 - DECLARATIONS

The Customer declares that they have the legal capacity to place an order for a Product on the Site.

The Customer undertakes to communicate to the Seller all the information necessary for the proper performance of the service offered by the Seller, in particular his/her name, first name, address, telephone number and e-mail. It is the Customer's responsibility to guarantee the accuracy of this information throughout the contractual relationship. In the event of inability to deliver due to an error by the Customer in his/her contact details, the Customer is held responsible and must bear any potential additional costs related to returning the Product.

Article 4 - ORDER

The Customer may place an order on the Site within the limits of available stocks, through the dedicated purchasing areas. To validate his order, the Customer must (i) accept these General Conditions by clicking, (ii) choose and provide an address and a delivery method, and (iii) validate his payment. An order is deemed validated only after acceptance of payment and collection by the Seller. Any order of a Product by the Customer constitutes acceptance of the prices and descriptions of the Product.

In certain cases, particularly in the event of non-payment, incorrect address, or a problem with the buyer's account, the Seller reserves the right to temporarily suspend or block the order until the problem is resolved.

The Seller undertakes to inform the Customer of the availability of the Products at the time of his order, before any payment. If, despite the Seller's best efforts, a Product is no longer available following payment by the Customer, the Seller will inform the Customer as soon as possible. The Customer will then have the option of canceling his order and being reimbursed for the full amount paid. This reimbursement is mandatory in all circumstances, but does not, however, give any right to any compensation or damages, and cannot engage the liability of the Seller.

Article 5 – SIGNATURE AND CANCELLATION

An order is deemed validated after acceptance of payment, either (i) by the online provision of the buyer's bank card number and (ii) by sending the buyer confirmation of acceptance of the order by the Seller by email. A validated order results in the payment of the amounts due under the order and the acceptance of all operations carried out. The Seller reserves the right to terminate and cancel an order within 48 hours of its validation, in particular in the event of a pricing error or an internal problem compromising the proper delivery of the Product. The Seller then undertakes to fully reimburse the Customer within 7 days of cancellation of the order.

In the event of fraudulent use of a bank card or identity theft, the Customer is invited to contact the Seller at the following email address: contact@mun-watches.com.

Computer records, including communications, invoices, purchase orders, and payments, are kept as proof by the Seller. Their archiving is carried out with the greatest care and in accordance with the legislation in force.

Article 6 – PRICE

The prices of the Products are indicated in EUR on the Site. These prices are subject to change at any time and without notice by the Seller, in particular in the event of an increase in taxes or variations in the cost of raw materials, exchange rates, or tariffs imposed by suppliers. However, for any validated order, the applicable price remains that in effect at the time of the order.

Ownership of the Products is retained by the Seller until full payment of the total amount of the order by the Customer. No deposit or partial payment gives the Customer any right of ownership over the Products ordered.

Article 7 - TAXES AND VAT

For orders placed by Customers residing in the European Union (EU), the prices indicated include the VAT applicable on the day of the order. Any change in the VAT rate will be automatically reflected in the price of the Products available for sale.

For orders placed by Customers residing outside the European Union, the Products are sold excluding taxes (HT) and excluding VAT, which means that VAT is not included in the sale price displayed on the Site. The Customer is solely responsible for any additional costs such as import taxes, customs duties, or other charges imposed by the customs authorities of his country of residence.

The Customer is therefore invited to inquire with the customs authorities of his country to find out about any additional taxes and fees applicable to his purchase. These fees, if applicable, are the exclusive responsibility of the Customer and cannot under any circumstances be claimed from the Seller.

Article 8 – METHOD OF PAYMENT

To pay for his order, the Customer has the payment methods made available by the Seller and listed on the site. The Customer guarantees to the Seller that he has the necessary authorizations to use the chosen payment method. The Seller reserves the right to suspend any order management and any delivery in the event of refusal of payment authorization. It may also refuse to honor an order placed by a Customer with an ongoing payment dispute.

Payment is made in full on the day of the order, by the following means: Stripe, Klarna, or bank card.

Article 9 - RETURNS AND REFUNDS

The Customer has a period of fourteen (14) days following receipt of his order to notify the Seller, via the address contact@mun-watches.com, of his wish to return the Product if he is not satisfied with it. After this period, no refund may be required.

For the return to be accepted, the Product must be returned in its original condition, unused, with its packaging and all original labels. The return costs are the responsibility of the Customer, who is required to insure the package up to the purchase value during the return shipment. The Seller will reimburse the Customer within fourteen (14) days of receipt and verification of the returned Product. The refund will be made by crediting the amount to the bank account used for the purchase.

If a package arrives damaged, opened or with missing Products, the Customer must refuse the package and issue a handwritten and signed reservation on the delivery slip. The Customer must also inform the carrier and the Seller within two (2) days. If the Products are damaged, a return request must be made within fourteen (14) days of delivery. The Products must be returned in their original condition with all accessories and packaging.

In the event of non-compliance with the return or exchange conditions, the Seller reserves the right to refuse reimbursement.

Payment is made in full on the day of the order, by the following means: Stripe, Klarna, or bank card.

Article 10 - DELIVERIES AND DELAYS

The Seller ensures the delivery of its Products in Europe and in certain countries outside the European Union, to the address indicated by the Customer when ordering. The delivery times displayed on the Site are given for information purposes only and represent the average processing and shipping times. They may vary depending on the availability of the Products.

In the event of a delay of more than fourteen (14) working days for the shipment of a Product in stock following payment by the Customer, the Customer may cancel the order by sending an email to the Seller. The contract will then be deemed terminated, and the Seller will proceed with the refund within fourteen (14) days.

However, once the package has been shipped, the order can no longer be cancelled. The Customer will have to wait to receive their package to be able to return it according to the conditions defined in the article "Returns and Refunds" if they wish to obtain a refund.

In the event of a delivery problem attributable to the carrier (loss or substantial delay), a claim procedure will be initiated by the Seller with the carrier in order to locate and recover the package. This procedure can take up to sixty (60) days. During this period, the Customer will not be able to demand a refund. The Seller undertakes to take all necessary steps with the carrier to facilitate the recovery or delivery of the package as soon as possible. At the end of these 60 days, if the package remains untraceable, the Customer may submit a refund request by email, in accordance with the provisions of the article "Returns and Refunds".

Article 11 - PRE-ORDERS

For pre-ordered Products, the delivery dates indicated are estimates and are provided for information purposes only. These deadlines are subject to production conditions and may vary depending on suppliers, supplies and logistical constraints related to the place of manufacture. The estimated delivery dates therefore do not constitute a contractual commitment.

Pre-ordered Products clearly display an expected delivery date, which may be extended by nine (9) months if delays occur in production or logistics. In the event of a delay of more than nine (9) months compared to the estimated delivery date, the Customer may cancel the order by sending a registered letter with acknowledgment of receipt to the Seller. The Seller will then reimburse the amount paid by the Customer within thirty (30) days following receipt of the cancellation request.

Once shipped, the pre-ordered Product can no longer be cancelled or refunded immediately. The Customer must wait to receive their package to return it, in accordance with the conditions stipulated in the article "Returns and Refunds".


In the case of a pre-order made via Kickstarter, no guarantee of delivery or refund is provided. Kickstarter pre-orders contribute directly to the financing of the production of the series of Products, and are subject to the specific conditions of use of Kickstarter. Indeed, contributors support a project in development which involves inherent risks, and do not place a classic order for a finished product. Orders placed via Kickstarter are therefore governed by the conditions of use of the Kickstarter platform and not by these general conditions of sale of Mu:n Watches, which means that no refund or return can be demanded by the Customer from the Seller. For more details on the applicable conditions, Customers are invited to consult the General Conditions of Kickstarter.

Article 12 - WARRANTY

Legal guarantee of conformity.

Article L217-4 of the Consumer Code “The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery”.

The company PLEINE LUNE guarantees the conformity of the goods to the contract, allowing the customer to make a request under the legal guarantee of conformity provided for in Article L. 217-4 of the Consumer Code. The guarantee does not apply in the case where the buyer was aware of or could not ignore the defect at the time of purchase or if the defect is the responsibility of the customer.

Legal guarantee of defects in the thing sold (hidden defects).

Article 1625 of the Civil Code “The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended (…)”.

The customer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the civil code. To do this (i) the defect must be hidden, (ii) the defect must exist on the day of acquisition, (iii) the defect must make the product unfit for the use for which it is intended. Unlike the legal guarantee of conformity, the defect must be proven by the customer, he can then (i) keep the good and request a reduction in the price (ii) return the good and request reimbursement of the sale price and costs incurred.

The legal guarantee applies independently of the commercial guarantee.

Article 13 - PROTECTION OF PERSONAL DATA

The Seller undertakes to protect the confidentiality and security of its Customers' personal data, in accordance with the provisions of the General Data Protection Regulation (GDPR) and applicable French data protection legislation.

The information collected when ordering (name, first name, address, telephone number, email address, and payment information) is necessary for processing the order, managing the commercial relationship, and may be used for monitoring, communication or service improvement purposes. This data will not be shared with third parties, except in the context of the delivery of the Products (carriers) or when required by law.

The Customer has the right to access, rectify, delete and port their personal data, as well as the right to limit or object to their processing. To exercise these rights, the Customer may send a request to the following address: privacy@mun-watches.com. A response will be provided within a maximum of one (1) month from receipt of the request.

Personal data is kept for a period proportional to the purposes of its processing and in compliance with legal obligations. In case of questions or concerns regarding data protection, the Customer is invited to contact the Seller at the address above.

Article 14 - AFTER-SALES SERVICE AND REPAIRS

The Seller undertakes to implement all necessary means to ensure the repair of defective Products. The repair costs are borne by the Seller provided that the warranty is still valid and that the defect found is not due to abnormal use or negligence on the part of the Customer. A Product is considered defective if the defect is proven and results from a manufacturing defect or a malfunction beyond the control of the Customer.

In the event that, during the repair, the Seller notices incorrect use, shock, or any damage not initially reported by the Customer, the repair costs will be borne by the Customer. The Seller will inform the Customer before carrying out any paid repair, in order to receive their prior agreement.

The Seller endeavours to ensure a rapid repair, but no fixed deadline can be guaranteed due to possible spare parts requirements and logistical delays. In any event, the Seller will keep the Customer informed of the progress of the repair.

If repair is not possible, the Seller may offer an alternative solution, such as replacing the Product or a credit, depending on the availability of the models and the after-sales service conditions.

If any provision of these terms and conditions is declared null and void or unenforceable by a court of competent jurisdiction, it shall not invalidate the remaining provisions. The present general conditions are subject to French law with regard to the rules of substance and form. Any dispute shall be subject to a prior attempt at amicable settlement.

 

Article 2 - Products

The Products offered for sale are presented on the Site and are accompanied by an exhaustive description of the product. All the Products offered are in conformity with the standards applicable in France.

The Customer acknowledges, prior to any purchase and to the conclusion of the contract, that he/she is fully aware of the present general sales conditions and of the information listed in article L. 221-5 of the French Consumer Code. This includes (i) the characteristics of the Product, (ii) the price of the Product, the method of calculation and the various applicable taxes, (iii) the transport costs, postage and other charges payable, (iv) the delivery period for which the Seller undertakes to deliver the goods, particularly in the case of a pre-order, (v) information relating to the Seller and its contact details, and (vi) information relating to the guarantees, their implementation and other contractual conditions.

 

All the Products offered on the Site are governed by the present General Conditions. The Products are offered within the limits of available stocks and presented with the greatest possible accuracy. In the case of (i) an error or omission by the Seller, (ii) a modification of the elements by the suppliers of the components allowing the creation of the Product by the Seller, (iii) a modification of the elements presented by the editor of the Site, the responsibility of the Seller cannot be engaged.

Article 3 - Declarations

The Customer declares to have the legal capacity to place an order for a Product on the Site.

The Customer undertakes to provide the Seller with all the information necessary for the proper performance of the service offered by the Seller, in particular his name, first name, address, telephone and e-mail. The Customer agrees to provide valid and up-to-date information. The Customer undertakes to inform the Seller, before the delivery of the Product, if his personal information changes. The Customer is responsible for the consequences related to the transmission of erroneous information, or of an illicit resumption of information. In case of inability to deliver due to an error of the Customer on his coordinates, the Customer is held responsible and will have to take charge of the potential additional expenses related to the return of the Product. 

Article 4 - Order

The Customer has the possibility to place an order on the Site within the limits of available stocks, through the dedicated purchase spaces. To validate his order, the Customer must (i) accept the present General Conditions by clicking, (ii) choose and provide an address and a delivery method, and (iii) validate his payment. An order is considered validated only after acceptance of payment and collection by the seller. Any order of a Product by the Customer implies acceptance of the prices and descriptions of the Product.

 

In certain cases, notably non-payment, erroneous address or other problem on the buyer's account, the Seller reserves the right to block the Buyer's order until the problem is resolved.

 

The Seller undertakes to inform the Customer of the availability of the Products at the time of his order, before any payment. If, despite the Seller's best efforts, a Product is no longer available following payment by the Customer, the Seller shall inform the Customer as soon as possible. The Customer will then have the option of cancelling the order and receiving a full refund of the amount paid. Article 6 - Prices

At the time of payment, the prices are indicated in EUR and take into account the VAT applicable on the day of the order. Any change in the applicable VAT rate is immediately reflected in the price of the Products available for the European zone. The prices are displayed without taxes and only take into account the VAT applicable for the member states of the European Union. Additional taxes and customs charges may apply for non-EU countries at the buyer's expense. The price of the Products may be modified at any time and without prior notice by the Seller, in particular in the event of an increase in taxes or contributions, a change in exchange rates or an increase in rates by suppliers. In the event of a price change, the prices in effect shall remain those indicated at the time of the order placed by the Customer. No payment can be considered as a deposit. No cash on delivery will be accepted. The property of the Product is kept by the Seller until the full payment of the price by the Customer.

 

Article 7 - Method of payment

To pay for his order, the buyer has, at his choice, all the payment methods made available by the seller and listed on the seller's website. The buyer guarantees the seller that he has the necessary authorizations to use the chosen method of payment. The seller reserves the right to suspend any order processing and any delivery in case of refusal of payment authorization. The seller reserves the right to refuse to make a delivery or to honor an order from a buyer who has not paid in full or in part a previous order or with whom a payment dispute is being administered.

The payment of the price is made in full on the day of the order, according to the following methods: Stripe or Paypal and by credit card.

Article 9 - Delivery, Returns & Refunds

The Seller delivers its Products in Europe and in countries outside the European Union. Deliveries to Russia are suspended. The products are shipped with the delivery note, to the delivery address indicated by the Customer when ordering. Delivery cannot be made to hotels or post office boxes. The delivery times indicated on the site are indicative times, corresponding to the average processing and delivery times or, in the case of a pre-order, the average production time of a Product. The Seller undertakes to inform the Customer as soon as possible of the progress of the processing of his order.

 

The Customer is required to check the condition of the Product. If the latter is damaged (except for the watch box), opened or missing, the Customer must refuse the package and note a handwritten and signed reservation on the delivery slip. The Customer undertakes to inform the carrier within two (2) days of receipt, and to send a copy to the seller, by e-mail or by post to the addresses indicated in the Legal Notice. If the Product(s) is (are) damaged, the Customer undertakes to make a request for return to the Seller within fourteen (14) days of delivery. Any claim made outside this period will not be accepted. The return of the product can only be accepted for products in their original condition (packaging, accessories, instructions...). The Seller will proceed to the reimbursement of the Product, as well as the shipping and return costs, fourteen (14) days following the reception of the Product, complete, in its original state and with all the labels.

In the case of a delay in delivery. In the case of an order for a Product in stock (hereinafter a "Stock" Product), and in the event of a delay in delivery of more than seven (7) working days, the Customer may cancel the order by registered letter, with acknowledgement of receipt, to the Seller's postal address. The contract shall then be deemed terminated, and the Vendor shall be obliged to reimburse the Customer for all sums paid, at the latest within fourteen (14) days of the date on which the contract was terminated. In the event of receipt of the product after the contract has been deemed terminated, the Customer shall be obliged to return the packaged and insured package within seven (7) days. The return of the product can only be accepted for products in their original condition (packaging, accessories, instructions...). The refund will be made within fourteen (14) days of receipt of the product.

 

In the case of an order of a Product in pre-order (hereafter a Product "in pre-order"), the delivery dates are purely indicative. They correspond to the production time of the Product estimated by the Seller, and depend on specific elements of the suppliers and countries of production. Pre-order Products explicitly show a purely provisional delivery date, which may be extended by nine (9) months. In the event of a delay in delivery of more than nine (9) months in relation to the delivery date indicated at the time of the order, the Customer may cancel the order by registered letter with acknowledgement of receipt to the Seller's postal address. The contract shall then be deemed to be terminated, and the Vendor shall be obliged to reimburse the Customer for all sums paid, at the latest within thirty (30) days of the date on which the contract was terminated.

 

In the case of Customer's dissatisfaction with the product received. The Customer has a period of fourteen (14) days following the receipt of the order to inform the seller at contact@mun-watches.com of his wish to return his order. Once this period has expired, the Customer is no longer able to request a refund of the product. Once the refund request has been confirmed by the seller in writing, the Customer must return the product within fourteen (14) days, with proof of shipment and insured for its purchase value. The product must be unused, in its original packaging and with all original brand labels still attached. Once the fourteen (14) day period has expired, the return is considered cancelled and the Customer must keep the product. The return or exchange is at the expense of the Customer.

The returned Product will be reimbursed within fourteen (14) days of its receipt by the seller, by crediting the amount to be reimbursed to the Customer's bank account.

If the Customer fails to comply with the present conditions, in particular the conditions of return or exchange, the seller shall not be able to proceed with the reimbursement of the Products concerned.

 

Article 10 - Warranty

Legal guarantee of conformity.

Article L217-4 of the French Consumer Code " The seller delivers goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery ".

The company PLEINE LUNE guarantees the conformity of the goods to the contract, allowing the customer to make a claim under the legal guarantee of conformity provided for in Article L. 217-4 of the Consumer Code. The guarantee does not apply in the case where the buyer was aware or could not have been unaware of the defect at the time of purchase or if the defect is the responsibility of the customer.

 

Legal guarantee of the defects of the sold thing (hidden defects).
